Practical guide with Spanish and European legislation.

When one of those called to inherit cannot be located, the distribution is stalled: the notarial partition cannot be signed due to a lack of unanimity or appearance.

The legal system offers several ways to resolve the issue : legal representation of the absentee, appointment of a court-appointed partitioner , judicial division of the inheritance , and intervention of the estate to secure assets and documentation.

Furthermore, there are mechanisms for notification by edict and cross-border cooperation (EU and Hague Conventions) that allow the process to continue without violating the right to defense.

In Spain, these tools are mainly found in the Civil Code (CC) , the Civil Procedure Law (LEC) and the Notary Law (LN).

What does “untraceable heir” mean?

He is the one who is called to inherit but cannot be summoned because his address or whereabouts are unknown.

In these cases, the Court Clerk (LAJ) can summon by edicts and call the Public Prosecutor to represent the absentees until they appear.

Initial steps to locate and leave a trace

Basic documentary verifications

Before considering extraordinary solutions, it's best to address the obvious:

  • Certificate of Acts of Last Will (to find out if there was a will and before which notary). This is requested at the Ministry of Justice headquarters, usually after 15 working days since his death.
  • Certificate of Registration of Life Insurance Contracts (in case there are policies with beneficiaries). It can also be requested electronically and is available until 5 years in the Making after the death.

With that information, the last intervening notary is located (if there was a will) and an authorized copy is obtained.

If there was no will, the declaration of intestate heirs is processed by notarial act before a competent notary (art. 55 LN).

Search and notification: when and how to use edicts

Once all efforts to locate the person have been exhausted (administrative inquiries, known addresses, etc.), public notice is the supplementary method.

Article 164 of the LEC orders publication through the Single Judicial Edictal Board (TEJU) of the BOE when no address is known or personal notification is impossible, with special privacy safeguards.

The text of the LEC itself also provides for the Central Register of Civil Rebels , to which the situation is communicated when the edictal notification has been necessary (art. 157 LEC).

Spanish legal framework: ways to continue without the absent party

Representation of the missing person and declaration of death

If a person disappears and there is no news, a defender may be appointed to represent them in urgent matters (art. 181 CC).

If their absence is prolonged, a representation regime is opened with the duty of inventory, guarantees and preservation of the assets (arts. 185 et seq.).

In extreme scenarios, a declaration of death is possible when the legal deadlines are met (generally 10 years; 5 if the absentee was 75 or older when the deadline expired), with succession effects.

When it helps : if the unlocatable heir is the "missing" person himself, representation or, where applicable, the declaration of death, allows the succession process to continue without indefinitely halting it.

Court-appointed partitioner (the agile and notarial option)

When there is no will or no appointed partitioner, the Legal Officer of the Administration of Justice or the Notary , at the request of heirs/legatees who represent at least 50% of the hereditary estate , may appoint a court-appointed partitioner (art. 1057.2 CC).

Article 66 LN develops the notarial competence to appoint and approve the partition if unanimous confirmation is lacking.

Designation: it is done at the notary's office in accordance with art. 50 LN (school lists and shifts), according to the art. 66 LN; in court proceedings the following applies LEC (e.g. art. 341 for raffles).
CC Base (50% requirement and approval): art. 1057.2 CC.

Why it unlocks : the court-appointed partitioner takes inventory, appraises, liquidates and divides , and the partition binds after notary approval or confirmation by all, preventing the non-appearance of one from blocking everything.

Judicial division of the inheritance (when there is no agreement)

Any co-heir or legatee of a fractional share may request judicial division (arts. 782-789 LEC).

Once the Board has been convened (art. 783), an accountant and experts are appointed; if there are minors without representation or absent of unknown whereabouts , the Public Ministry represents them until they appear or can be summoned personally.

This provision is key when an heir is untraceable.

Evidence and guarantee note : in parallel, if appropriate, the intervention of the estate is activated (arts. 790-796 LEC) to secure assets, papers and correspondence of the deceased, appointing a judicial administrator (arts. 797-805) until the inheritance can be divided and delivered.

Declaration of intestate heirs and publicity

If there is no will, the LN regulates the declaration of heirs by notarial act (arts. 55 and 56 LN).

The notary verifies family relationships, identities, addresses and, when necessary, orders notifications, summonses or publications to ensure that potential interested parties —including an unlocatable heir— can be informed and appear.

European tools (when the heir is in another EU country)

Successions with a cross-border element (Regulation 650/2012 and ESC)

Regulation (EU) 650/2012 establishes, as a general rule, the applicable law and jurisdiction based on the habitual residence of the deceased , allowing the choice of the law of nationality (professio iuris).

Introduce the European Certificate of Succession (ECS) , which proves the status of heir, legatee, executor or administrator and is effective in all participating Member States (excluding Denmark, Ireland, and the United Kingdom).

The official forms are available on the European e-Justice Portal.

Why it unlocks : If part of the estate or an heir is in another EU country, the CSE avoids continuously "re-accrediting" the inheritance status and facilitates registrations and bank payments in several States.

Notification and obtaining of evidence in the EU

When it is necessary to notify an heir in another Member State, Regulation (EU) 2020/1784 (recast) streamlines the transmission and practice of notification/transfer of documents , with electronic channels and forms.

For evidence (e.g., hearing witnesses or requesting foreign banks), Regulation (EU) 2020/1783 governs judicial cooperation.

Both rules reduce time and prevent nullities due to lack of communication.

Public documents within the EU: fewer formalities

Regulation (EU) 2016/1191 eliminates legalization and apostille for certain public documents (birth, death, marriage, absence of criminal record, etc.) when they circulate between Member States, with multilingual forms.

Useful —for example— for providing death certificates or civil status certificates without an apostille.

Outside the EU or with third countries: Hague Conventions

  • Postscript 1961: abolishes diplomatic legalization; one is sufficient apostille issued by the competent authority of the country of origin of the document.
  • Notification 1965 (Hague Service Convention): channels the international notification through Central Authority and alternative routes, with standardized forms.

These tools are the standard when the untraceable heir is outside the EU or the document comes from a State not covered by Regulation 2016/1191.

Typical routes to unlock (depending on the case)

Scenario A: Full inheritance in Spain; one co-heir does not appear

  • Attempts to locate and TEJU edicts if applicable. 2) Dative counter-partitioner (50% of the salary) and notarization If unanimity is lacking. 3) In parallel or subsidiarily, judicial division with representation of the absentee by the Public Prosecutor's Office and, if appropriate, flow intervention to secure assets.

Scenario B: Real estate or accounts in another EU country

  • Decide competition y applicable law by Regulation 650 / 20122) Process CSE to prove inheritance status in the other State. 3) If it is necessary notify there, use Regulation 2020 / 1784.

Scenario C: heir resides outside the EU

  • Apostille for public documents and 1965 Convention all with notifications2) If it is not a State party, it will be necessary to legalize through consular channels and resort to the internal regulations of the third country.

Operational Checklist

  • Succession titleWill? → ask Wills; if not, deed of heirs (arts. 55-56 LN).
  • Insurance: consult the Death insurance registration.
  • Location: reasonable attempts + TEJU if applicable (art. 164 LEC).
  • Notarial procedure: request dative counter-partitioner (art. 1057.2 CC and art. 66 LN).
  • Judicial way: division (arts. 782-789 LEC) and, if necessary, flow intervention (arts. 790-796 LEC) + administration (arts. 797-805 LEC).
  • EU cross-border: CSE and regulations 2020/1784 (notification) and 2020/1783 (evidence).
  • Outside the EU: Postscript 1961 y Service 1965.

FAQ's

Can I "divide" without that co-heir?

Yes, through a court-appointed partitioner if you represent at least 50% of the estate (or judicially) and complying with notifications/public notices. Notarial approval substitutes for the lack of confirmation from the absent party.

Who represents the absent heir in court?

The Public Prosecutor's Office until it appears or can be summoned personally (art. 783.4 LEC).

How can I ensure that no one "moves" the property while I'm searching?

With the judicial intervention of the assets : inventory, deposit and administrator with delimited powers (arts. 790 and 797-799 LEC).

How much does the European Social Fund (ESF) help if there are assets in another EU country?

Avoid repeated procedures and prove your inheritance status uniformly across participating Member States.

Conclusion

The non-appearance of an heir does not condemn the inheritance to stagnation.

With proof of search and notifications (including edicts), the notarial impulse of the court-appointed partitioner or the judicial division with intervention of the estate allows progress with guarantees.

If there is an international dimension, the CSE and EU regulations — or, outside the EU, the Apostille and Hague Service — provide the necessary framework for the succession to be successful while respecting rights and procedures.
