Civil law

Civil law in Spain is characterized by regulating the civil status of properties, real rights, inheritances, obligations and contracts, generally covering all aspects related to people. Of a private nature, this branch of law establishes the relationships between spouses, ascendants and descendants, which justifies the need to resort to the services of a lawyer specialized in family law in case of legal disputes.

In turn, civil law is broken down into four large areas:

• General part: Includes aspects such as nationality of residents in Spain, your domicile, the extinction of civil personality and the acquisition of properties.
• Contracts and obligations: Defines the rules that govern the general and special legal regime related to the drafting of contracts and the acquisition of obligations. It also addresses both contractual and non-contractual responsibilities.
• Family and inheritance law: Regulates relationships between spouses, parents and children, as well as inheritances and the modalities of contracting marriage and establishing other civil unions.
• Real property law: It focuses on the ownership and possession of assets, highlighting mortgage law. Likewise, it establishes the fundamental principles of guarantees and preferential acquisitions.
