What is the EU Blue Card?

The European Union Blue Card is a residence and work permit designed for non-EU citizens who wish to pursue a highly qualified profession in an EU member state.

This permit is valid in all Member States, with the exception of Denmark and Ireland.

Its creation dates back to the Directive 2009/50 / EC, subsequently updated by the Directive (EU) 2021/1883, with the aim of attracting international talent and meeting the demand for qualified professionals in key sectors for the European economy.

Requirements for obtaining the EU Blue Card

Equivalent training or professional experience

A university degree or similar qualification is required. Alternatively, qualifications can be demonstrated by a minimum of three years of professional experience or five years of acquired skills.

Employment contract or proposal
skilled

It is necessary to present a signed employment contract or a firm job offer for a position that requires high qualifications, with a minimum duration of six months from
the start of the
exercise.

Salary conditions in accordance with the
regulations

The contract must comply with the working conditions set forth in the applicable collective bargaining agreement, and the salary offered cannot be below the threshold established by the regulations: between 1,0 and 1,6 times the average annual gross salary in Spain.

Request for authorization from the employer

The application process involves both the employer and the employee, and can be processed from the country of origin or directly from Spain, depending on the case.

Typically, the hiring company initiates the process by submitting the application for residency and work to one of the following agencies, as appropriate:

Documentation to provide

To start the procedure, it is mandatory to present the following documentation:

  • Company NIF: Document that proves the tax identity and legal existence of the contracting entity.

  • Identification of the legal representative: Proof that accredits the person with the authority to act on behalf of the company.

  • Form EX-05: Official form duly completed and signed by the company or its representative.

  • Work contract: Copy signed by both parties, with a minimum duration of six months and in accordance with current regulations.

  • Certificates of tax and social security compliance: They certify that the company is up to date with its tax and labor obligations.

  • Job Description: Document detailing duties, job requirements and required qualification level.

  • Proof of financial solvency: Demonstration that the company has sufficient resources to undertake the contract.

  • Employee's resume and training documentation: Include an updated CV and academic qualifications or equivalent professional experience.

  • Complete worker's passport: Full copy of the valid passport.

  • Proof of payment of the administrative fee: Model 790, code 038, duly paid.

Deadlines to take into account

The administration has a period of 45 business days to resolve the request, counted from the day following its presentation.

If no resolution is issued within this period, the request is deemed rejected due to administrative silence.

If authorization is granted, the company must immediately register the worker with Social Security.

Procedure after the favorable resolution of the initial authorization

Once the authorization has been granted, the worker has one month to visit the Spanish consulate in their country of origin and apply for the corresponding visa.

You must submit the following documentation:

Complete, valid and current passport.

Recent photograph in format

Criminal record certificate issued by the authorities of the country of residence.

Residence permit issued by the
UGE-CE.

Payment of the fee

Proof of residence in the consular district.

Entry to Spain

Visa applications are usually processed within approximately 10 days of submission. Once issued, and upon entry into Spain, the worker must apply for a Foreigner's Identity Card (TIE) at the Immigration Office or the police station corresponding to their residence. This card certifies legal residence as an EU Blue Card holder and must be applied for within one month of entry into Spain.
